1. Acceptance of Terms
By subscribing to and viewing This Might Be Cringe ("Newsletter," "we," "us," "our"), you agree to these Terms of Service ("Terms"). If you disagree, do not subscribe or access our content.

Applicability: These Terms apply as of the Effective Date above. For interactions prior to this date, Substack’s Privacy Policy and Terms of Service were in effect.

2. Relationship with Substack
This Might Be Cringe is hosted on Substack, which provides the technical platform for subscription management, payments, and data storage. By subscribing, you also agree to Substack’s Privacy Policy and Terms of Service.

In the event of any conflict between our policies and Substack’s policies, Substack’s policies take precedence where applicable.

3. Subscriptions & Payments

  • This Might Be Cringe offers free and paid content via Substack.

  • All subscriptions, billing, and payments are handled directly by Substack through their payment provider Stripe.

  • Payments, billing cycles, and cancellations are subject to Substack’s Terms of Service.

  • By subscribing to a paid plan, you acknowledge that you are authorizing recurring payments unless canceled before the next billing cycle.

  • No refunds are issued for partial subscription periods or unused content. You understand this by subscribing.

4. Payment Disputes & Chargebacks

  • All payments are processed through Stripe via Substack.

  • This Might Be Cringe does not offer refunds on paid subscriptions.

  • By subscribing, you acknowledge and agree that all charges are final and non-refundable. You agree not to initiate chargebacks or payment disputes for any reason.

  • If you dispute a charge through your payment provider, Stripe may determine the outcome of the dispute, and their decision is final.

  • If a chargeback is initiated, we reserve the right to provide Stripe with proof of subscription, including:

    • The email address associated with the subscription.

    • The date and time of subscription.

    • Any engagement metrics (e.g., email opens, clicks) demonstrating use of the service.

    • Confirmation of successful payment processing.

  • If a chargeback is ruled against us, we reserve the right to immediately terminate your subscription, revoke access to all paid content (past and future), and permanently block you from accessing any current or future content, including free and paid offerings.

  • Fraudulent chargebacks may result in permanent removal from our platform and legal action, including but not limited to, financial recovery through small claims court or other legal means.

  • Any legal action related to fraudulent chargebacks will be pursued in the courts of New York, United States.

5. Content & Ownership

  • While This Might Be Cringe retains ownership of all original content, it is distributed via Substack’s platform, which has its own terms regarding content hosting and moderation.

  • You may share excerpts with proper credit and a link back to the original post.

  • Redistribution, modification, or commercial use of our content without permission is prohibited.

6. Community Guidelines

  • Subscribers are encouraged to engage respectfully in comments, replies, and chat.

  • We reserve the right to moderate, delete comments, or block users violating our guidelines.

7. Disclaimers

  • Content is for informational and entertainment purposes only.

  • Any persons mentioned are referenced for information, discussion, or entertainment purposes only.
